This paper analyzes the status of the implementation of the Electronic Medical Record (EMR) in Italy, focusing on the transition from analog to digital systems. Through a definition of medical record and outlining its structure and primary functions, the distinction between the Electronic Health Record (EHR) and the EMR is then clarified, examining their Italian equivalents: Fascicolo Sanitario Elettronico (FSE) and Cartella Clinica Elettronica (CCE). Moreover, an overview of key European initiatives that aim to enhance health data exchange and interoperability in support of EMR development and adoption is presented. The discussion then turns to the Italian context, examining: i) the transition phase from analog to digital in medical record workflows; ii) the differences between the management and preservation of analog and digital medical records; iii) the probative value of analog versus digital records; and, iv) the legal requirements for long-term preservation of medical records and their contents
